Lawsuits Against (and pertaining to)
Capella
University and Capella Education Corporation
Considering that Capella University is run by a bunch of jerks and
liars, why should it surprise anyone that Capella has already been
involved in several lawsuits - on topics ranging from Copyright Infringement
to Employment Disputes? Interestingly, while Capella University's
Chief Counsel, Greg Thom, has already demonstrated that he is a liar,
and has no problem following the lead of the porn industry (while
ignoring real institutions of higher learning), Capella certainly
likes to settle things off the record. Fortunately for us, the lawsuits
that have already been filed against Capella Education Corporation
(and Capella University) have left a rather interesting paper trail!

Current Lawsuits
- Mary Swenson (student) vs. Sharon Bender (Capella University "instructor") - (filed 2007 in Anoka County, Minnesota). While Capella University has not been named as a plaintiff in this case, it does involve one of their former instructors, Sharon Bender, who has been accused of plagiarizing one of her students while still employed at Capella. Unfortunately, lawsuits filed in many state courts are not available on the Internet: therefore, we are unable to post any documentation regarding this case. Articles about this lawsuit have been published by the Pioneer Press (Minnesota) and the Chronicle of Higher Education. We look forward to Ms. Swenson's victory in this matter.
- Capella
University v. Executive Risk Specialty Insurance Company (filed
02/14/06) - In yet another attempt to bilk money from others,
Capella University is now suing their insurance company because
their claim has been denied!
- La Marca
v. Capella University filed in United States District Court
on June 3, 2005. Student files lawsuit against Capella University
for their intentional discrimination against students with disabilities,
vulgar acts of retaliation against such students, blatant disregard
for the First Amendment, and other equally vile actions.
- La
Marca v. Capella University - United States Court of Appeals for
the Ninth Circuit - while the original La Marca v. Capella
University case is currently stalled in the lower (District) court,
an appeal regarding the lower court's decisions pertaining to
Capella's frivolous counter suit has been filed.

Lawsuits Filed by Students
- Mary Swenson (student) vs. Sharon Bender (Capella University "instructor") - While Capella is not a plaintiff in this case (too bad they aren't), one of their former instructors is. Sharon Bender is being sued on allegations of plagiarizing one of her Capella student's work!
- La Marca v. Capella University (filed:
June 30, 2005) - Capella University is sued on allegations of maliciously
violating of the Americans with Disabilities Act – including
retaliation by Capella officials and alleged violations of other
laws.
- Beattie v. Capella
University, et al (filed: 10/08/04, closed:
3/25/05) - This case concerns problems regarding the Fair Debt
Collection Act. Apparently, Capella's thugs were involved in unethical
collection activities. As has been their habit, Capella University
signed a confidential agreement to close this case. Hmmm...
- Firth v. Capella
Education Co., et al (filed: 06/27/2002,
Date of last filing: 01/10/2003) - This case appears to be one
in which Capella University intentionally shafted a student
who then sued on charges including Breach of Contract!
Lawsuits Filed By Employees
- Christensen v. Capella Education Company filed in United States District Court on October 13, 2006. A Capella University Enrollment Director sues for harassment and discrimination! This one was settled out of court. Got any information about this case? Post it on our forums.
- Brezinski v. Capella
Education Co., et al (filed: 11/21/2003, Date of
last filing: 01/16/2004) - Capella University was sued for Job
Discrimination. Somehow, that doesn't surprise us in light of
their discrimination against students with disabilities! What's
next, Capella? Blatant racism?

Lawsuits Filed Against Capella Officials
- Michael Offerman - Capella's President and CEO:
- Markel
v. Board of Regents of the University of Wisconsin System -
Apparently, Michael Offerman threatened (and, in our opinion,
attempted to blackmail) an employee before he fired her.
Sadly, the United States Court of Appeals for the Seventh Circuit
dismissed that case but Michael Offerman's actions, we believe,
speak for themselves. Disgusting. The
following paragraph was obtained from the court record:
"In May 1999, armed with this information, [Michael]
Offerman and Breitkreutz confronted Markel. They asked
Markel about her involvement with Learning W@rks, and gave
her written notice of the charges of dismissal and a chance
to respond. Offerman told her that in order to avoid dismissal
she needed to either write out and sign a statement outlining
what she knew about the new business or resign. Markel
refused to sign a statement and said she would need to
consult with an attorney before answering Offerman's questions.
The meeting ended, and Markel was forced to cease work
immediately and return all UWLI property. However, the
next step in the process to terminate Markel was not taken,
and she was paid in full until the end of her contract
on June 30, 1999. Markel later filed an appeal of the dismissal
and requested a hearing, but because her contract had already
ended and it was nonrenewable, Offerman withdrew the dismissal
charge.
