Shawn Ambrose Revealed!

The following contains the complete text of the declaration that Shawn Ambrose filed on behalf of his employer, Capella University. The only thing we've added are comments and links to appropriate sources along with some other rather amusing items. Additional information about Shawn Ambrose may be found on the pages dedicated to him elsewhere on this site.

1. I am a Ph.D. student of Capella University, School of Business and Technology (Capella), and have been working towards my Ph.D. in Organization and Management since April of 2003. I make this declaration in support of Capella's Reply Brief in Support of Opposition to Plaintiff's Motion to Strike. I make these statements of my own personal knowledge, and if called, could and would testify competently thereto.
2. I am a Staff Sergeant in the Wisconsin National Guard. I have served in the Army National Guard for more than eighteen years. I was deployed from February 2004 through April 2005, and served in Iraq.

3. I am employed full-time by Lac Courte Oreilles Ojibwa Community College, in Wisconsin, as a business faculty member. This college is located on a Native American reservation and my students are predominantly Native Americans. I am a member of the Andrew Jackson University adjunct faculty pool. In January 2006, I became an adjunct faculty member for Capella, teaching Principles of Organizational Communication.
4. I am not an employee of Capella. In my capacity as an adjunct faculty member for Capella, I am an independent contractor for the limited purpose of teaching a particular course. I receive no workers' compensation, health or retirement benefits from Capella. I have not been issued business cards from Capella. As an independent contractor for Capella, I cannot and do not attend regular faculty meetings. I cannot be a part of any standing committee for the University. I do not participate in any Capella sponsored employee activities.

5. I first became familiar with Plaintiff, (La Marca) while I was stationed in Baghdad, when I read and responded to two of his electronic posts made on Capella discussion boards, in June and July of 2004. The first was a post by La Marca on Capella's "General Discussion Board" where he described filing a complaint with the United States Department of Education, Office of Civil Rights (OCR), against Capella regarding accessibility issues with WebCT for those with learning disabilities. In responding to La Marca's post, it was my purpose to try and understand the problems he was experiencing, and assist, if I could, in resolving his complaints. A true and correct copy of La Marca's post, my responding post and his reply are attached collectively as Exhibit 17.
6. La Marca's second post occurred in June of 2004 where he maintained Capella had censored discussion board threads. I again responded and pointed out to him where I believed the archived posts had been placed.. A true and correct copy of La Marca's post, my response and his reply are attached collectively as Exhibit 18.
7. The last post I recall seeing from La Marca on the Capella discussion boards occurred on July 17, 2004 where he provided a link to his site at www.capellauniversitysucks.us. I registered at www.capellauniversitysucks.us on July 23, 2004 under my first initial and last name, and posted the short message, "how pathetic," which reflected my opinion of the site, and "EOM" for "end of message.". Almost immediately, I was banned from posting and blocked from accessing his site. A true and correct copy of a portion of my post is attached as exhibit 19.

8. I registered another time on www.capellauniversitysucks.us on October 1, 2004, under the name "Capella Rocks." My selection of name was in response to the numerous posts by La Marca under the name "CapellaSucks" and "CapellaStinks."

My post as Capella Rocks was in direct response to La Marca, who was posting on this site as "AbusedByCapella." In his post, La Marca discussed the complaint he had filed against Capella with OCR. He included the docket number "OCR Docket #05-04-2092" and described the situation as a complaint against high ranking officials at Capella University. A true and correct copy of his (later edited) post as "AbusedByCapella" and my response is included herein as Exhibit 20. I was subsequently banned from posting and blocked from his argument referring to my past problems with drugs and alcohol, accusing me of having brain damage as a result, calling me a drunkard, apparently classifying me as a jerk and liar from Capella, and a wacko. The statements contained in this Exhibit are similar to other remarks made by La Marca on his own website or posted by him on discussion boards located on other websites. Although I have had previous substance abuse issues, I achieved and have maintained sobriety, since August of 1992. All of
La Marca's statements disparage my character and accomplishments and make false claims about me.

12. While La Marca maintains that the information I obtained from OCR and posted on the Internet is false, all of the materials I have posted were obtained from OCR by a FOIA request.
13. I am in the process of earning a Ph.D. at Capella in order to enhance my professional qualifications. Consequently, the value that other educational institutions and perspective employers place on my degree is a matter of some concern for me. The manner in which La Marca has carried on his vendetta against Capella, the relentless posting of inaccurate and highly one sided information and the constant referral to unsupported and often specious allegations may influence how future employers will view my academic credentials. I have attempted to counterbalance that effect by posting, whenever possible, accurate information in response to La Marca's statements.

14. At no time have I consulted with any Capella official concerning the posts I have made with regard to La Marca, nor have I submitted any of my material for Capella review. I have not been officially sanctioned to be a Capella spokesperson. Rather, the postings I have made are a part of my desire to insure [sic] that those who view La Marca's material also have some access to accurate information.
