Capella Crimes: Chris L'Orange's Lies Exposed

Due to Capella University's grossly outlandish demands and refusal to negotiate in good faith (or, for that matter, anything even remotely resembling "good faith"), the lawsuits regarding Capella University and their obscene acts of retaliation against those who rightfully expose their evil, continue. In fact, as Capella's attorneys from the "law firm" (try not to gag) of Drinker Biddle & Reath, H. Christian L'Orange (aka, Chris L'Orange) and Stella Fey Epling, have literally told so many outright lies in written documents to the courts, as well as during actual court procedings, that a new "book" has just been created to provide some very specific examples (i.e., hard documentation) as to the absurdity of some of those lies. In fact, Chris L'Orange has told one of those lies so many times, and has consistently refused to provide even a single shred of evidence to back up his bizarre (and they are truly bizarre) wild accusations, we're certain he won't mind the fact that the TRUTH is now being revealed. Of course, as Drinker Biddle & Reath (which also serves as one of Capella University's Congressional lobbyists) has already racked up well over $700,000 in "legal fees" L'Orange has a vested interest in keeping the money flowing in (perhaps so he can take more extravagant vacations to tropical paradises in order to swim with hammerhead sharks - oh yeah, and bring some pencils with him to toss at the local peons).

Fact Seventy-one (November 7, 2007) – Capella University’s Chief Shyster, Liar Greg Thom, Cashing in on Insider Options

Every time Capella’s stock goes up, several of their insiders cash in on their stock options – this time, their chief shyster, Greg Thom (who has lied to Federal Law Enforcement agencies) made almost a third of a million dollars ($297,070.00) in less than two days. Perhaps he’s afraid he won’t get many more opportunities to do so after his lies are finally exposed during the upcoming trial against Capella University. As Capella’s other lying shysters, especially Sir Chrisy the Sissy L’Orange and Horse’s Ass, Capella Stella Fey Epling, have consistently refused to turn over documents (they’ve already been reported to a Federal law enforcement agency), we’ve posted the Security and Exchange document which shows Shyster Greg Thom’s latest transaction. One of Greg Thom’s most infamous lies concerns the fact that he knowingly and willfully lied to a Federal law enforcement agency that he (and Capella University) intended to reply to the student they were retaliating against and allow that student to reenroll at Capella. Later, Greg Thom then lied again, this time to a different Federal law enforcement agency that this same student was “not officially disenrolled [Capella-speak for “expelled”] until 1/3/2005” – a mere five days after he told the other law enforcement agency that the student would be allowed back.

It is an irrefutable FACT that shyster Greg Thom lied, multiple times, to Federal law enforcement agencies (yes, that’s plural) as well as to a Federal Court. CLICK HERE to view some of the details. BTW, Greg Thom also lied about turning over education records belonging to the student he abused, which a Federal law enforcement agency has just found TEN violations of law – and that investigation is still open! It would also appear that shyster Greg Thom and charlatan Diane Stottlemyer are having a race – to determine who can either tell more lies or buy more degrees, respectively. It’s a good thing shyster Greg Thom is cashing in on his stock options now – before his lies and unethical behavior are fully revealed in Federal Court.

Fact Seventy (November 6, 2007) – Capella University Kickback Scam in the News Again

Once again, the Capella University kickback scam is in the news again. According to today’s Chronicle of Higher Education reports,

“KICKED BACK: An arrangement under which Capella Education Company had been paying the University of California at Irvine $500 for each UC student who transferred to Capella was abruptly halted in October, two weeks after it was made public in a Chronicle news story. The UC system said, in a written statement, that it was ending the five-year relationship because outsiders were "misconstruing this as somehow being, if not illegal, unethical." Under the arrangement, Capella paid Irvine $500 for every continuing-education student referred to it. Capella had paid at least $12,000 to Irvine under the program. The cancellation also affected a three-year relationship Capella had had with the University of California at Berkeley. No money was paid to Berkeley during the period, other than an initial $5,000 set-up fee.”

Of course, Capella’s unethical lying president’s (Michael Oaf Offerman) refusal to disclose how many other schools Capella pays kickbacks to is not mentioned – that would require that Offerman abide by his bogus initiative, “Transparency by Design” which is nothing more than a publicity stunt - along with Michael Offerman personal involvement in the fact that Capella University has (and continues to) violated Federal law. As reported a few weeks ago, Capella University has already been found in violation, on TEN counts, of the Family Educational Rights and Privacy Act.

Fact Sixty-nine (November 4, 2007) – Capella University Can’t Keep Faculty or Employees!

Sure, Capella University is a scam – their President, Michael Oaf Offerman, engages in lying, intentionally violates Federal law (FERPA) and continues to do so even when his “school” is found guilty on TEN DIFFEREN COUNTS by a law enforcement agency, continually exploits the media with endless publicity stunts (such as his latest “Transparency by Design” initiative) which makes absurd bogus claims about the importance of “accountability”; their “executive directors” (Capella-speak for “dean”), such as Kurt Linberg, are inarticulate morons who can’t spell even the simplest of words or write a complete sentence and yet are placed in positions that any real university, would never consider for such a position – especially when, like Linberg, have no real teaching experience; and retains charlatans, such as Diane Stottlemyer, who have literally bought and used fake degrees from diploma mills.

Just a revealing is the FACT that Capella University can’t keep their “faculty.” While Capella’s hiring practices, designed to save as much money as possible (no wonder fakes like Diane Stottlemyer are permitted to “teach”) by employing a whopping 86% of their “faculty” as “independent contractors” (Capella-speak for “adjuncts”) – which, by itself, reveals just how little respect they have for having real academics on their payroll, they keep another, very disturbing, set of statistics well hidden from public view (as we’ve noted, Michael Oaf Offerman is a blatant liar who intentionally HIDES information from public view – so much for his bogus concern for “accountability”). That information would include reporting on the extraordinary turnover of their full-time “core faculty” (which only amounts to a mere 14% of Capella’s instructors).

So, how does Capella University hide this major problem? It’s really quite simple – just try to find old editions of their “catalog” – unlike real universities, Capella withdraws all previous versions from their web site as soon a new edition appears. Let’s take a quick look at just two of these “catalogs” which cover a period spanning just three years – the first was obtained in July 2004 and the second one which from this month 2007. Just for fun, we thought we would look at Kurt Linberg’s “schools” – back in July of 2004, Linberg was the “executive director” for Capella’s now defunct “School of Technology.” After a huge scandal and the previous “executive director” of their “School of Business” was fired, let go, or was asked to resign, Capella combined both “schools” into one entity – their “School of Business and Technology.” According to their July 2004 catalog, the “School of Technology” had ten “core faculty.” Today, a mere three years later, a whopping 80% of those “core faculty members” no longer appear in Capella’s catalog! An examination of Capella’s 2004 “School of Business” “core faculty list” reveals that 79% are no longer listed in their 2007 catalog! Then, when one looks at Capella’s combined 2004 “core faculty” lists and compares them with the “core faculty” list from this year, an incredible 79% no longer work for Capella! That’s right, of the 24 total “core faculty” members who were on Capella’s payroll in 2004, an incredible 19 of them are gone!

Now, let’s take a look at just how unstable Capella’s faculty really is. Assuming that only 14% of Capella’s instructional staff is employed as full-time “core faculty,” their current School of Business and Technology, should consist of roughly, 24 full time and 147 part-time (independent contractors) or 171 instructors in all. As only five members of their “core faculty” has survived over the past three years, their so-called “School of Business and Technology” currently contains less than THREE PERCENT of what should presumably be considered their most important asset – full-time experienced educators. How many real universities have turn over rates that are so abysmal?

Wait a minute! Capella’s inability to keep employees isn’t just limited to “core faculty” – it’s appears to be endemic across all employees listed on their apparently full-time employee lists for the “School of Business and Technology!” In comparing the lists from 2004 against those from November 2007, only 16 out of 75 employees remain! Again, that’s a turnover of approximately 79% in just three years!

As always, we’re sure that Capella’s sleazy and unethical shysters from the “law firm” of Drinker Biddle & Reath, Sir Hank Christian L’Orange the Liar and Horse’s Ass Capella Stella Fey Epling, would also intentionally ignore the hard documentation that notes Capella’s employment problem, so we’re providing links to the actually materials that confirm the fact that moron Linberg just can’t seem to keep his employees; click on each of the following to view the two sets of lists from 2004 (for both “schools”), along with the new one from November 2007. We’ve taken the liberty to highlight, in red, those faculty members and employees on the 2004 lists who are now apparently gone from Capella’s payroll.

Fact Sixty-eight (November 3, 2007) – Capella University’s Spelling Champ, Kurt Linberg, Teaching Experience?

At Capella University, those with previous teaching experience need not apply. That’s right – no EXPERIENCE needed. All that counts is the self-centered desire to make big bucks while, at the same time, abusing students (oops, make that LEARNERS). Take, for example, Capella’s dishonest “Executive Director” for their so-called “School of Business and Technology,” Kurt Linberg – you know the one, the guy that can’t write a Capella sentence if his life depended upon it and never did learn how to spell even the simplest of words. (CLICK HERE to view a sample.) So, just how does a dishonest liar like Linberg become an “Executive Director” (Capella-speak for “dean”)? According to his resume (which is freely available on the Internet) Kurt Linberg has NEVER TAUGHT as a full-time faculty member at ANY institution of higher learning or, for that matter, at a diploma mill. That’s right, Capella’s most dishonest “dean” has apparently NEVER taught! Of course, why should we be surprised? Don’t believe us? Take a look at a copy of his resume! CLICK HERE to view it. (We’re sorry for the continual emphasis on links to documents that prove what a dolt Linberg is but Capella’s unethical and lying shysters from the “law firm” of Drinker Biddle & Reath, Sir Chrisy the Sissy L’Orange and Horse’s Ass, Capella Stella Fey Epling, have a nasty habit of ignoring hard evidence – especially when they’re lying to the court).

Let’s take a look at another one on Linberg’s bios, this one came from Capella’s own web sight [sic] (Yes, Linberg is unable spell something as simple as that). As will soon be noted, Linberg’s illiteracy is highlighted by the fact that he begins EVERY SENTENCE with the personal pronoun “I.” While that may fit his ego, it certainly says a lot (oops, according to Linberg alot [sic] is a compound word) about someone who serves as a “Dean” at a “university.” Why would any real school hire someone, like Linberg, who has never taught and who is unable to write a simple sentence? Just for fun, here’s Linberg’s bio from Capella’s sight [sic]:

“I received my PhD in Applied Management and Decision Sciences from Walden University, an MS in Software Engineering from the University of St. Thomas in St. Paul, Minnesota, and a BS in Applied Mathematics from the University of Wisconsin-Stout. I have also published a number of papers on topics such as IT management, software development, and project management. I hold eight patents on mission-critical IT implementations. I am also a longtime member of the IEEE, ACM, and ASQ, and currently serves on the Advisory Board of NUTN. I have held executive level positions with the ACM SIGITE organization as well as the Minnesota Information Professional Society.”

In case you missed it, there were five sentences (we know that Sir Chrisy the Sissy L’Orange has a fetish for counting things), all of which began with “I”:

Impressed? We’re not. Perhaps Linberg’s literacy problem is part of the reason he hires and retains charlatans, such a Diane Stottlemyer (who literally buys and uses fake degrees from diploma mills) and allow snot-nosed punks, like Brian Imholte (who only has a BS), to serve as chief kangaroo on one of Capella’s Kangaroo Courts against graduate students, in which Linberg retaliates against those who stand up to his abuse, incompetence, and illegal actions. These matters also say nothing at all about Capella HUGE personnel problems (which we’ll be disclosing in our next post).

Fact Sixty-seven (November 2, 2007) – Capella University’s Spelling Champ, Kurt Linberg, Gets a Hangnail

Oops, we should have said that Capella’s moronic “Executive Director,” Kurt Linberg of their “School of Business and Technology” just accepted yet another meaningless award (i.e., another opportunity for a press release) – this one bestowed by the “Minnesota Tekne Awards.” What, you never heard of it? Gosh, what a surprise. Of course, this is just another example of Capella receiving an “award” from a Minnesota-based awards presentation (we were surprised to find that, unlike other meaningless awards they’ve received, Capella wasn’t listed as a sponsor). A quick glance at the “About the Award” page for the “Minnesota Tekne Awards” web site is essentially nothing more than a description of what the “award” looks like (gosh, that’s impressive); specifically:

“Each sculpture incorporates a unique piece of Blenko Glass that has been hand fractured and mounted behind a steel Tekne ‘t’ logo. Each sculpture is unique in that each piece of handmade glass exhibits distinctive characteristics of shape, color, bubbles and swirls in the color and density that are the result of the process of pouring the molten, handmade glass and then hand cutting each piece.”

As far as we’re concerned that probably also accurately describes Linberg’s feeble brain – with lots of “bubbles and swirls” that is also very “dense.” Perhaps that’s why Kurt Linberg is such a blatant liar who hires alot [sic] (according to Linberg, “alot” is a compound word) of charlatans like Diane Stottlemyer, who literally buy and use fake “graduate degrees” from diploma mills). Of course, Linberg is such a liar, that he also fraudulently uses Stottlemyer’s fake “titles” (i.e., DOCTOR Stottlemyer) to law enforcement agencies when they’re investigating Capella University. Not surprisingly, Linberg is such a moron that he refuses to cite (or was that sight or site) where Stottlemyer bought her “degrees” (Lacrosse “University)? Heck, Linberg is such a moron that he wouldn’t know the difference between these or other homonyms – CLICK HERE to view an actual example from a web sight [sic] that moron Linberg actually posted on the Internet – and was left there for seven years. BTW, that web sight [sic] was created for the “doctoral degree” he bought from the esteemed “Walden University” (another online “school” also from Minnesota [Where else?]) Linberg finally removed it from the Internet after we pointed out his embarrassing web cite [sic]! About the only thing worse than Linberg’s innate ability to bastardize the English language would be the ever-evolving lexicon now widely recognized as “Capella-speak.” Between Linberg’s ineptitude combined with Capella-speak, there are now alot [sic] of knew [sic] words for LEARNERS to yous [sic]. It’s just too bad that someone from Minnesota doesn’t give Linberg an award for being the most moronic “executive director” at Capella University. Now that would be great material for their next press release!

Fact Sixty-six (November 1, 2007) – Capella University’s Moronic CEO Drivels About “Transparency by Design”

Once against Steve Tonka Shanks, Capella’s moronic CEO has driveled all over the Internet regarding Capella’s profits and Michael Oaf Offerman’s “Transparency by Design” initiative. Capella University’s lying shysters (Hypocrite Hank Christian L’Orange and Capella Stella Fey Epling, from the “law firm” of Drinker Biddle & Reath) favorite mantras in their frivolous and pernicious countersuit concerning how much “damage” those who exercise their First Amendment Rights have caused Capella's to the seemingly endless and ever-increasing flow of money into Capella’s coffers, not to mention all of the LEARNERS (Capella-speak for “student”) who are continuing to spend big bucks at Capella, shows what a bunch of morons these shysters are – Capella’s bottom-line remains astronomical. According the Tonka Shank’s own PR spittle, just released today, Capella’s

“Revenues for the three months ended Sept. 30, 2007, increased by 26.5 percent to $55.5 million, compared to $43.9 million in the third quarter of 2006.” and

“Total active enrollment reached 20,268, an increase of 23.8 percent over the same period in 2006.”

The old adage that “There's a sucker born every minute” certainly applies here – if prospective “LEARNERS” are willing to spend big bucks at Capella University – it’s their loss. Just the same, for Sir Chrisy the Sissy Hank L’Orange and Horse’s Ass Capella Stella Fey Epling to whine about how much “damage” those who speak out about Capella’s unethical and illegal actions cause, is simply ludicrous.

Let’s move on to some of Steve Tonka Shank’s most absurd oral excrement that has just been spewed at the media:

“We are also pleased with the progress that has been made nationally on important higher education issues such as accountability in learning outcomes transparency,” said Shank. “As part of the Transparency by Design Initiative, Capella and a group of other higher education institutions will publicly share information that will provide prospective students with quantitative data to help choose where they want to pursue their post-secondary education. Our work in this area reflects our vision to lead the definition of high-quality adult online education,” concluded Shank."

Oh really Mr. Tonka? Perhaps you should stop following the lead of your unethical and lying administrators and shysters and start telling the truth! For starters:

1. Why not tell all about the fact that your degrees-for-dollars “school” has been, and continues to, violate Federal law! That’s right, Michael Oaf Offerman and chief shyster Greg Thom have been PERSONALLY involved in Capella’s refusal to abide by the Family Educational Rights and Privacy Act for MORE THAN THREE YEARS. When are you going to disclose the TRUTH and provide “provide prospective students with quantitative data” that Capella University continues to violate the law?

2. How about disclosing a list of ALL schools that Capella University pays kickbacks to (the story of which was recently exposed by the national news media) as well as disclose the amount of cash flowing into Capella’s coffers from those schools? As you know, Michael Oaf Offerman and his equally unethical buddy at the University of California, Irvine, Gary Moneybags Matkin, intentionally tried to HIDE their kickback scam (until the media exposed it). Why won’t the so-called “leader” of “Transparency by Design” – again, Oaf Offerman, tell reporters how many schools Capella has kickback agreements with? Yes, it is a FACT that Offerman has been REFUSING to answer that and related questions. Guess that makes Steve Tonka Shanks an unethical hypocritical liar just like the other Capella goons.

3. Capella has been forced to disclose the FACT that yet another law enforcement agency, the United States Department of Education, Office of the Inspector General, has been auditing Capella’s books for the past year and a half for stealing “less than a million dollars” but refuses won’t provide all of the details. Why not?

It’s a good thing that Shank’s “vision to lead the definition of high-quality adult online education” is based upon ongoing violations of Federal law and unethical conduct.

Fact Sixty-five (October 29, 2007) – Capella University & “Transparency by Design” Bedfellows?

We’ve just uncovered another interesting situation which may, or may not, be relevant. As the news media has been reporting on the kickback scam between Capella University and other schools (including the University of California, Irvine [UCI]), whereby Capella’s dishonest and lawbreaking President, Michael Oaf Offerman, has been personally involved in making unethical deals with some of his “buddies” (in particular, Gary Moneybags Matkin, Dean of Continuing Education and Kickback Studies at UCI) in which Capella University pays kickbacks to other schools for feeding students into their substandard programs, we’ve noticed the sharp increase in PR and marketing drivel spewing forth from Capella’s spin doctors over the past week. One of the most hilarious is Offerman’s latest PR stunt whereby he is proclaiming that Capella University intends to be publicly “accountable” for all of their actions (give us a break)! That PR scam is entitled, “Transparency by Design” and is led by none other than Michael Oaf Offerman. As to be expected, nearly all of the other “schools” participating are for-profit, online “colleges.” The “Transparency by Design” initiative is little more than academic flatulence, filled with total nonsense (as evidenced by Offerman’s own ongoing dishonest behavior). Interestingly, this so-called initiative is sponsored in part by Excelsior College, where good ‘old Oaf Offerman’s wife, Dana Offerman, just happens to be the “provost” (she used to work at Capella). It gets even better, though! The president of Excelsior College is John Ebersole, who recently introduced Offerman at the Press Conference held to launch “Transparency by Design.”

So far, so good – Oaf Offerman, Dana Offerman, and John Ebersole are all in “leadership” positions at the two “schools” that seem to be screaming the loudest about their commitment to “accountability.” While we can’t comment on the quality (or lack thereof) of Ebersole’s Exlax [sic] College, we can say with certainty that using the name Capella University in the same sentence as the term “accountability” is obscene.

So, just what do these facts have to do with the price of beans? Well, a simple Google search turns up the fact that Ebersole used to be a high ranking official with the University California, Berkeley Extension Programs. While we can’t make a connection (at least not yet) between the fact that UC Berkeley Extension also had a kickback arrangement with Capella University and Ebersol (for all we know at this time, he may not have been involved) but we have learned is that Ebersol also involved in other projects with none other than UCI’s Gary Moneybags Matkin! Not only that, but prior to coming to UCI, Matkin also worked at UC Berkeley. Hmmmm. Could there be some kind of good ‘ole boys triangle between Offerman, Matkin, and Ebersol? We don’t know. Just the same, in light of Offerman’s intentional acts of trying to hide the kickback scam with Matkin’s programs, along with the fact the Offerman’s personal role in the recent determination that Capella University has been intentionally violating Federal law, for well over three years, by refusing to comply with the Family Educational Rights and Privacy Act (FERPA) which has now been exposed, is certainly very disturbing. Furthermore, Ebersol’s high profile participation in the “Transparency by Design” charade which touts “accountably” while, at the same time, having multiple connections to Offerman, Capella University, and UCI’s Gary Matkin, certainly doesn’t look too slick. While all of this remains speculation (at least at this time), the ongoing unethical and illegal actions Offerman and his school, certainly raises a lot of valid questions. Only time will tell. The fact that Capella University, led by their lying unethical president, Michael Oaf Offerman, and their sleazy chief shyster, Greg Thom, have violated Federal law is not surprising – after all, we’ve long reported on the hypocritical and unethical antics of these two liars. Equally disturbing is that Offerman and Thom have continued to violate the law – more than a month after Capella was told to comply. Just for fun, we thought we would do an Internet search to find out how many other universities and colleges have been caught in violation of the Family Educational Rights and Privacy Act (FERPA) and were quite surprised to find that Capella University is certainly in very sparse company – in fact, we’ve only found three other schools and the last violation (as far as we could find) occurred more than seven years ago. Gosh, it looks like Michael Oaf Offerman and his dishonest shyster, Greg Thom, are in a very, very lonely field.

Of course, this also highlights what a barefaced liar and hypocrite Michael Oaf Offerman is – just how difficult is it for him to demand that his “school” turn over education records as defined under FERPA? He’s already had more than three years to comply with the law. It’s certainly not rocket science. Perhaps Offerman is just too busy cashing in on his insider stock options (he’s made well over two million dollars during the past few months) and hypocritically proclaiming how Capella University is “accountable” for their actions. We find his participation in the so-called “Transparency by Design” initiative to be simply outrageous. In addition to Offerman’s personal involvement (along with shyster Greg Thom) in violating Federal law, Offerman has also displayed his hypocrisy by refusing to discuss how many schools Capella accepts kickbacks from for referring students into their substandard programs “taught” by charlatans (like Diane Stottlemyer) who have bought bogus degrees from diploma mills.. Interestingly, once the news media unveiled Offerman’s attempt, along with his equally unethical buddy, Gary Moneybags Matkin, Dean of Kickback Studies at the University of California, Irvine to hide their kickback agreements (they didn’t want to “startle the lawyers”), Offerman has refused to disclose how many other kickback agreements Capella University has made with other schools. Obviously, Offerman hasn’t a clue as to what “accountability” mean. Instead of holding press conferences where he spews more of his hypocritical drivel, we suggest that Offerman should start on obeying the law.

Capella University's lawbreaking President, Michael Oaf Offerman, caught in another publicity stunt - this time hypocritically touting the so-called "Transparency by Design Project" which proclaims that participant "schools" agree to abide by specific standards of "accountability." The only problem is, Michael Oaf Offerman not only doesn't know what accountability means, but he engages in activities designed to coverup his unethical conduct!

We are now pleased to release our much awaited "documentary" (okay, so it's been doctored to highlight the fact that Michael Oaf Offerman is a lawbreaking liar) regarding the so-called "Transparency by Design" initiative (i.e., publicity stunt) led by Capella's own Oaf Offerman. We've taken the liberty to glean some of Offerman's drivel from the sales pitch he recently gave at the National Press Club. Of course, Michael Oaf Offerman ignored the fact that he has been personally involved Capella's intentional violation of Federal law (for which Capella has just been found in violation on TEN different counts - and the investigation is still raging on). A real college president would have had something that Offerman lacks – INTEGRITY – and would have demanded that his school comply with the law immediately. Of course, Offerman is simply too dishonest to do that; in fact, nearly a full month has now transpired and his “school” still hasn’t complied with the law - guess Offerman figures that his "school" has already violated the law for well over three years - why should they start complying now?

Of course, Oaf Offerman also refused to discuss the FACT that he was personally involved in the kickback scam whereby Capella has been collecting $500 per student that gets referred into their substandard programs (especially from his buddy, Gary Moneybags Matkin's school, the University of California, Irvine. Again, that would require something called INTEGRITY.

Then there’s the problem that Michael Oaf Offerman has previously intentionally lied about another one of Capella’s bogus studies – the so-called “WebCT Usability Study” that Michael Oaf Offerman personally stated was, “universally praised for being exceptionally user-friendly and intuitive.” That too is a lie and, more than three years later, Offerman still refuses to turn over anything that even remotely resembles such nonsense (because it doesn’t exist). With that in mind, we hope visitors enjoy our parody of what Offerman’s “Transparency by Design” initiative publicity stunt should have looked liked.

In addition, Oaf Offerman's latest publicity stunt – the "Transparency by Design Initiative" (or was that the "Deceit on Purpose Initiative?") – in which Oaf Offerman slobbered all over the media at a National Press Club conference on Monday where he proclaimed that "schools" like Capella "have the courage to do the right thing and publicly report our outcomes in order to enable people returning to college to make informed decisions." Of course, Oaf Offerman, as usual, refused to display any courage – none whatsoever - by failing to mention the fact that he and shyster Greg Thom, as the "official representatives" of a for-profit scam, have just been caught violating Federal law. Furthermore, the fact that Oaf Offerman and Greg Thom continue to violate that law by refusing to comply with the findings of a law enforcement agency within the United States Department of Education, only solidifies the FACT that Oaf Offerman and Shyster Greg Thom are also dishonest liars.

Fact Sixty-one (October 22, 2007) – Capella University Unethical Actions Make Headlines AGAIN!

Gosh, what a surprise – the grossly unethical conduct of Capella University and their chief shyster, Greg Thom, make headline news AGAIN! Just how many headlines can these sleazebags make? One thing for sure, Capella University is now getting the attention they have long deserved. The latest attention comes from the "New University," the terrific student newspaper at the University of California, Irvine. The top story (!!) for this week’s edition is entitled,

"UC Irvine No Longer to Receive Capella Cash"

The New University has reported that,

"The profitable articulation agreement formulated in fall 2002 between UC Irvine Extension and Capella University, a Minneapolis-based for-profit online institution, will be concluded by Oct. 31, 2007, according to UCI Dean of Continuing Education Gary W. Matkin.

"According to the agreement, UCI receives $500 for every student referred to Capella. The agreement allows UCI Extension students to transfer their credits to Capella in the hope of obtaining a master’s degree from one of their graduate programs.

"The agreement was concluded after critics proposed that Capella’s compensation provisions create strong financial incentives for college counselors to direct students to Capella instead of offering them fair and unbiased advice."
While UC Irvine is canceling their agreement with Capella, so are other universities within the UC system. According to the widespread article that appeared in San Francisco Bay Area newspapers over the weekend, "UC Berkeley Extension retracts contract with online school":

"Current [UC Berkeley] administrators, who [spokeshole] Guy said were not involved in signing the contract three years ago, ended the Capella agreement after University of California leaders asked extension officials to review such pacts.

"At that point, the dean and the CFO looked at it and said, 'We don't even need this,' Guy said. 'At UC Berkeley Extension, we want to rise to the highest ethical standards.'"

Bravo! It's great to see that the administrators at UC Berkeley "want to rise to the highest ethical standards" – it's rather disgusting that Gary Matkin and UCI Extension obviously don’t care about ethics – they only canceled their contract with Capella because the media has been rightfully blasting away at their unethical practices.

Getting back to the New University article, they are the first to expose Capella University's chief shyster, Greg Thom, for what he is – someone who has intentionally helped Capella University violate Federal Law for more than three years (and, even now, they refuse to comply). The New U reported,

". . . Capella has been found to be in violation of 10 counts of the Family Educational Rights and Privacy Act [FERPA] as a result of refusing to turn over [the plaintiff’s] records.

"The matter is still under investigation by a law enforcement agency within the U.S. Department of Education [USDE]. [The plaintiff] told the agency that 'Greg Thom, the chief counsel of Capella, is at the center of that complaint for his refusal to abide by the law.' The case will go to trial on Nov. 13 in Santa Ana."

Of course, this revelation is not new – it's just that the New U is the first to mention the FACT that shyster Greg Thom is at the very center of the complaint – he is the one who was calling all of the shots and was the one who has also intentionally lied to the USDE (multiple times, no less). The events surrounding Capella University's violation of Federal law (FERPA) over the past few weeks have also exposed Capella's unethical, sleazy, scumbag defense attorneys, Hypocrite Hank Chris L'Orange and Horse's Ass, Capella Stella Fey Epling, from the “law firm of Drinker Biddle & Reath] for what they really are – LIARS – and that's a FACT. Let's take a look at some of these unethical shysters' behavior.

It is a FACT that Horse's Ass Capella Stella Fey Epling engaged in grossly unethical conduct when she tried to write a letter, on behalf of the USDE law enforcement agency investing Capella’s FERPA violations, exonerating shyster Greg Thom. More on that true story may be found by CLICKING HERE.

Naturally, the USDE rightfully refused to oblige shyster Epling's unethical request and never permitted her to write such a letter.

Then, just a few weeks ago – a mere week before Capella University was found GUILTY of violating FERPA not just once but TEN TIMES, Hypocrite Hank Chris with the Rusted Codpiece L'Orange intentionally LIED to a Federal Court AGAIN (yes, he has personally lied to the Federal Court multiple times). In this instance, L'Orange the Liar filed a "motion in limine" – a court document that he is using to try to use to prevent the fact that Capella University is not only still under investigation regarding the FERPA matter but also the FACT that shyster Greg Thom is at the very core of that investigation. "[The plaintiff] has repeatedly alleged that Thom is being personally investigated by the Family Policy Compliance Office ("FPCO") in connection with his claim that the entirety of his educational records had not been produced in accordance with the Family Education Rights and Privacy Act ("FERPA"). No documents (except those created by [the plaintiff]) even remotely suggest that Thom is being, or has ever been, personally investigated by the FPCO, a governmental agency which investigates institutional compliance - not individual compliance - with FERPA."

FACT: Chris L'Orange is a liar! The plaintiff has never said that Greg Thom is being "being personally investigated" by the FPCO. The plaintiff has always stated that shyster Greg Thom is the primary SUBJECT of that investigation. Of course, ever-the-legal-scholar, Sir Chrisy the Sissy L'Orange is such a veritable moron that he wasn’t even aware of FERPA prior to the lawsuit. In fact, during one of his abusive depositions, he repeatedly referred to FERPA as FERPRA. Furthermore, ambulance chaser L'Orange should have received a copy of the letter regarding the fact that it has already been determined that Capella University violated the law TEN TIMES. In that letter, shyster Greg Thom is personally mentioned not once, not twice – but TWELVE TIMES within the body of that letter. As L'Orange seems to enjoy counting things (such as his BLATANT LIE that our sites had more than 25,000 pages), we thought we would take a look at who came in second place: that honor goes to Capella's snot-nosed punk and grand Pooh-Bah of one of their kangaroo courts, Brian Imholte – who is only referred to a mere four times.

Not pleased with his lies to the Federal Court about the FACT that Greg Thom IS THE PRIMARY SUBJECT in the investigation regarding Capella's intentional violation of Federal Law, Sir Chrisy the Sissy L'Orange then tried to claim that Capella's violations of FERPA have nothing to do with the pending lawsuit against the "university." Specifically, Looney L’Orange had the audacity to state,

"Consequently, any evidence of the nonexistent but alleged investigation of Thom by the FPCO for a violation of FERPA is irrelevant to the issues presented in this action. Any evidence sought to be introduced would not be relevant to the accommodation issues, and would solely address whether all of [the plaintiff’s] required education records were produced to him, an issue wholly unrelated to whether he received appropriate accommodations. Therefore, under Federal Rule of Evidence 402, any such evidence is inadmissible and Defendant respectfully requests this Court enter an order excluding it."

Uh? What? Perhaps Moron L'Orange needs to have someone read the FERPA violations letter to him - better yet, perhaps he needs to go back to law school and learn about education law. (Note, we have to make such links very clear to our readers as shyster L'Orange, as a rule, NEVER provides the court with the documents that show he's a liar. Wonder why?)

Of course, in his whiny "motion in limine" to the court in which he is attempting to prevent highly relevant evidence regarding shyster Greg Thom's dishonest behavior and Capella's violation of the law, Moron L'Orange seems to have forgotten that Capella is also being sued for their intentional retaliation against a student and that Capella’s Kangaroo Court (led by snot-nosed Brian Imholte) not only denied all due process to that student but also REFUSED to provide highly relevant information regarding the matter. Let’s not forget that the incompetent morons from Chicago's OCR Office, Mark Farr and Linda McGovern, also NEVER OBTAINED ANY OF THE DOCUMENTS that Capella has been illegally hiding.

Oh well, it looks like we’re dealing with an entire sounder of pigs lead by a couple of highly unethical lying shysters – Greg Thom and Sir Chrisy the Sissy L'Orange.

According to Capella University latest pile of PR drivel, Michael Oaf Offerman is moving on to a new "position" designed to "expand his national role." As Michael Oaf Offerman has been personally involved in the scandals that have been exposed over the past couple of weeks – Oaf Offerman was PERSONALLY involved in illegal actions of his "university" whereby Capella intentionally violated Federal law, as well as the kickback agreements he signed with his "buddy" Gary Moneybags Matkin, Dean of Kickback Studies at the University of California, Irvine, we can't help but wretch at the thought that Offerman is trying to further promote his unethical practices. According to Capella’s latest marketing stunt,

"Stephen Shank, chairman and CEO of Capella Education Company [stated], "As the leader of the Transparency by Design educational accountability initiative, Dr. Offerman's national role has been expanding. By creating an interim university leadership team, we will be able to continue to leverage Dr. Offerman's leadership, while allowing him more time to focus on his new role."

Gosh, isn't that special? Let’s take a brief look at some of the "principles" of Oaf Offerman's latest nonsense. As with all dishonest and unethical jerks, Offerman's new "project" is rife with hypocritical educational BS which contains so much hyperbole that we can't help but wonder if ANYONE who is real academic (which Oaf Offerman most certainly is NOT) will take seriously. Just the title of his nonsense should make any intelligent person laugh:

"Transparency by Design: Principles of Good Practice for Higher Education Institutions Serving Adults at a Distance"

In light of Offerman’s ongoing dishonest and unethical behavior, we can’t help but wonder who his ghost writer is! "Transparency by Design?" Just what kind of nonsense is that? Let's look at a few of these "principles" (BTW, does Offerman have ANY principles? We think not!); here are a few examples:

"Principle 2. Accountability to Stakeholders: The institution demonstrates its accountability to stakeholders by openly sharing aggregate learning assessment results, quality indicators, and academic program reviews of its distance education courses and programs."

Oh really? What about Offerman's blatant lies and refusal to produce Capella's "WebCT Accessibility Study" which he stated was "UNIVERSALLY praised for being exceptionally user-friendly and intuitive?" Besides the FACT that the study has never existed, why won't he produce it for the world to see. Oaf Offerman is such a hypocrite that he clearly has no idea as to what "accountability to stakeholders by openly sharing aggregate learning assessment results, quality indicators, and academic program reviews" means!

"Principle 12. Disclosure: The institution discloses throughout its marketing and communications, accurate, truthful information about its mission, accreditation, courses and programs, services, policies, transfer credit policy, tuition and fees, use of recruitment incentives, its recruitment processes, and other factors important to prospective and current students and other stakeholders."

Disclosure? DISCLOSURE?! Michael Oaf Offerman must be smoking something if he even remotely believes that. Why won't he DISCLOSE all of the kickback scams Capella's involved in? Why did he intentionally try to HIDE his kickback agreements with his equally unethical buddy at UC Irvine, Gary Moron Matkin, Dean of Kickback Studies? Offerman is such a blatant hypocrite that he won't even respond to demands from the national news media (the Chronicle of Higher Education and the Los Angeles Times) when they've demanded full DISCLOSURE of all of Capella’s unethical practices regarding the finders fees they pay to other "schools."

A far better name for Oaf Offerman's latest project would be, "Kickbacks by Design" – at least that would accurately describe his lack of ethics.

In light of the news media reports on the latest kickback scam involving Capella University and their unethical cohorts within the University of California system (including UC President Robert Dishonest Dynes, UC Irvine [UCI] Chancellor Michael Frankenstein Drake, and UCI Dean of Continuing Education and Kickback Studies Gary Matkin) appear to be frantically trying to put out the fires now popping up all around them. Since the Chronicle of Higher Education first published the story about the unethical signed agreements between Capella's President, Michael Oaf Offerman and his good 'ole boy buddy, Gary Moneybags Matkin whereby Capella has been PAYING UCI to feed students (or was that "LEARNERS?") into Capella's substandard programs – including those "taught" by charlatans, such as Diane Stottlemyer, who literally bought and used fake degrees she purchased from a diploma mill (Lacrosse "University"), the media has been uncovering more details in this mushrooming story. In addition to the Chronicle article, the Los Angeles Times revealed the fact that more than one UC school signed on with Capella – including Gary Moneybags Matkin's old employer, the University of California, Berkeley.

Disgustingly, Moneybags Matkin has continued to display what a disgrace he is to higher education – in addition to the fact that he KNEW that Capella's courses are taught by charlatans such as Diane Stottlemyer, and he KNEW that Capella University harasses and retaliates against students, he had no problem helping out his buddy – Oaf Offerman. There can be no question that Moneybags Matkin places MONEY above the interests of students. That, course, is only compounded by Matkin's utterly asinine comments to the Times such as,

"Everything we did was perfectly legal, straightforward and in the best interests of our students.

"People are misconstruing this as somehow being, if not illegal, unethical, so we're just going to stop."

Obviously, Gary Moneybags Matkin is a complete imbecile who would rather allow his buddy's "school" to rip-off the very same students who he claims he's looking out for. Again, it is a fact that Makin, the Dean of Kickback Studies at the University of California:

1. KNEW that Capella subjects student to charlatans like Diane Stottlemyer.

2. KNEW that Capella was retaliated against a student who had complete approximate 16 courses, with a 4.0, while at UCI and had already spent approximately $10,000 in UCI's programs prior to being subjected to the incompetence at Capella.

3. KNEW that Capella University was engaged in violating Federal law by refusing to turn over education records as required by the Family Educational Rights and Privacy Act (FERPA).

It is also a FACT that at the same time Matkin is professing to watch out for "the best interests" of UCI student, he also refuses to respond to students requests for assistance with the unethical and illegal practices at his buddy's school. Like all greedy bastards, sleazeball Matkin as forwarding students requests for assistance to his equally corrupt and unethical "buddy" at Capella, Michael Oaf Offerman.

Not surprisingly, Gary Matkin is too STUPID to understand (as the Los Angeles Times rightly noted) that,

"Critics say incentive-based agreements such as that between UCI and Capella are unethical because they turn college counselors into salespeople."

Matkin the Moron even had the audacity to tell the Times that,

"he planned to place $12,000 from the extension program's budget into a scholarship fund for needy students"

. . .from the money that Capella kickbacked to UCI. Of course, Matkin doesn't mention the other money that Capella has also been coughing up to Matkin’s school. Guess Matkin just happened to forget that Capella paid UCI a whopping $40,000 to just to "design" six online courses. Of course, there could be more money that neither Capella nor UCI are revealing.

Perhaps the most disturbing matter is that Gary Moneybags Matkin and Michael Oaf Offerman have been engaging in this kickback scam for the past five years and that they intentionally tried to hide their own lack of ethics. The Chronicle of Higher Education reported that,

"Gary W. Matkin, dean of continuing education at Irvine, wrote an e-mail message in September 2002 to Capella's president, Michael J. Offerman, to tell him that Capella's "lawyers still have problems with our marketing arrangement, even though we have been careful not to talk about per-student arrangements."

And Gary Moneybags Makin doesn't "understand" why

"people are misconstruing this as somehow being, if not illegal, unethical?"

Capella University's unethical practice of paying kickbacks to schools such as the University of California, Irvine (UCI) has been exposed once more – this time by the Los Angeles Times. Not only that, but the Times has also exposed new information about the fact the Capella University has kickback arrangements with two other schools within the University of California system – UC Berkeley and UC Santa Cruz. It appears as if UC Berkeley may have also signed a kickback agreement with Capella but, allegedly, none of UC Berkeley's students were scammed into transferring into Capella. Not surprisingly, Gary Matkin, the unethical Dean of Continuing Education, just happens to be good buddies with Capella University's equally unethical President and liar, Michael Oaf Offerman, is trying to worm his way out of this scam. According the LA Times,

"Gary Matkin, UCI's dean of continuing education, said the money was used to market students' eligibility to transfer to Capella in the extension program's quarterly catalog, on its website and through letters sent to students. Matkin, who set up the arrangement in 2002, said, 'Everything we did was perfectly legal, straightforward and in the best interests of our students.

'People are misconstruing this as somehow being, if not illegal, unethical, so we're just going to stop.'"

Surely, Gary Matkin is a complete moron if he sees nothing wrong with his school's unholy alliance with Capella University. Of course, Matkin is such a jerk that he tires to hide the FACT that he, UCI's moronic Chancellor, Michael Drake, and the extraordinarily unethical president of the entire UC system, Robert Dynes (you remember him – he;s the one that politicians and members of the public, alike, screamed for his resignation when it had been exposed that Dynes has been living like a king off of taxpayer dollars), all KNEW about the fact that UCI was taking kickbacks, as well as the FACT that the Capella instructor, Diane Stottlemyer, who is at the heart of the lawsuit currently pending against Capella, had bought fake degrees from a diploma mill. As with all dishonest and unethical sleaze bags like Gary Matkin, Michael Drake, Robert Dynes, and Michael Oaf Offerman, they sat around and did NOTHING. Well, that's not exactly true. Gary Matkin is such a dishonest and unethical moron that instead of responding to complaints about the corruption at Capella, he COOPERATED with Capella in their sleazy defense against the student.

Before we continue, we want to point out what the unethical money-mongers from the UC system KNEW about the Capella situation more than two years ago (they've had more than enough advance warning prior to the recent news reports about the unethical Capella-UC kickback scam). The following thugs all received e-mails about the situation:

* Gary Matkin, Dean of Continuing Education and Kickback Scams at UCI

* Michael Drake, UCI Chancellor and Oaf (who has been involved in numerous scams including (but not limited to) the recent Erwin Chemerinsky scandal, the black-market sale of body parts (yes, you read that correctly). * Robert Dynes, the corrupt President of the entire UC System, is such an unethical scumbag that he had that audacity to admit,
"to a culture in his office of 'trying to get away with as much as possible and disclose as little as possible.’"

* Michael Oaf Offerman, Capella’s President and Liar - Oaf Offerman may not officially work for the UC system, he's certainly the first thug that Gary Matkin whines to when UCI students complain about the corruption at Capella. As a result, we're including Offerman in this list because Matkin (and perhaps Dynes and Drake) refused to respond to complaints but had no problem forwarding them onto Capella and their shysters.

Now that we've got that settled, readers will be interested in reading parts of one of the complaints that had been sent off to Dynes and his goons:

"UCI has been receiving money, from Capella University, for marketing their diploma mill. As I mentioned in [an earlier] correspondence to you, the 'instructor' at the heart of [the] lawsuit against Capella literally purchased her 'degrees' from another diploma mill. It is abhorrent to think the University of California, as a respected public institution, is helping to market a for-profit scam like Capella University. Why?"

"Capella University pays UCI for students who enroll and then complete some of their courses at their diploma mill. Why?"

"In light of the fact that at least one of [the] 'instructors' [Diane Stottlemyer] at Capella literally purchased her "graduate degrees" from a diploma mill (Lacrosse University), why does the University of California continue to endorse Capella University?"

Wonder why scumbags Matkin, Drake, and Dynes refused to respond? Obviously, they've not only endorsed the Capella-UC kickback scam for more than two years but also have also endorsed Capella's practice of hiring charlatan's like Diane Stottlemyer.

The Los Angeles Times, like the Chronicle of Higher Education, met with the same kind of moronic excuses from one of Capella University's spokesholes, Michael Walsh. The Times stated that,

"Michael Walsh characterized the referral fees as 'tuition-sharing payments' to offset UCI's costs for marketing his school's programs."

Clearly, Walsh is just another two-faced moron. "Tuition-sharing payments?" Give us a break! Walsh is simply too dishonest to say that Capella University has been paying KICKBACKS!

The Times then reported that,

"Capella has 'numerous' credit-transfer programs, mostly with community colleges, Walsh said, but he declined to disclose how many involve per-student payments."

So, spokeshole Walsh, just how many community colleges are receiving kickbacks from Capella? What are you so AFRAID to tell the truth?

The Times shed some new light on other "alliances" that Capella has with other UC schools; the article mentioned a spokeshole from Robert Dynes Office, Chris Harrington, who stated that "[UC] Santa Cruz does not receive payments." Gosh, perhaps Chris Harrington is one of the people from Dynes Office who tries "to get away with as much as possible and disclose as little as possible.’" (Click HERE to see the San Francisco Chronicle Article where sleazebag Dynes makes that statement.)

The Los Angeles Times stated that Ann Guy, a spokeshole from UC Berkeley, (oops, we almost forgot to mention that Gary Matkin worked at UCB before moving on to lead the Kickback Studies programs at UCI) commented that,

"Berkeley also is ending the program because of the public perception of ethical problems, said Ann Guy, spokeswoman for the university's extension program."

Getting back to another one of Gary Matkin the Moron' asinine statements, the Times noted,

"Because it [Capella University] is for-profit, I [Matkin] felt that it was logical for us to seek some sort of compensation for the marketing we are doing for them," Matkin said, "so we asked them to give us money for the number of students that matriculated to them."

Is Matkin REALLY that STUPID? Why of course he is! WHY is a non-profit state school MARKETING for a for-profit scam like Capella University. There is NOTHING logical about that. Oh yeah, we almost forgot, Gary Matkin and Capella’s President, Michael Oaf Offerman are good ‘ole boys.

The Time article concluded with a real kicker:

"David Hawkins, director of public policy and research for the National Association for College Admission Counseling, in Alexandria, Va., said such arrangements appeared to be in conflict with the association's ethical code, which bars member schools from accepting payments for placing or recruiting students. UCI is not a member, but UC Berkeley is.

'Any time you reduce the basis of recruitment to cash kickbacks or commission sales, the ability and willingness of recruiters to act in the interest of students goes downhill quickly," he said.'"

It should be very evident that Gary Moneybags Matkin, Michael Frankenstein Drake, Robert Dishonest Dynes, and Michael Oaf Offerman all have something other than the interest of students in mind – their own self-centered hides. Frankly, they should all be fired.

Fact Fifty-five (October 12, 2007) – Capella University: Dana Offerman Reveals the Truth

Gosh, that's a surprise considering the source – Dana Offerman, former "Vice Provost" of Capella University & wife of Capella’s feeble President, Michael Oaf Offerman (can you spell NEPOTISM?) who is now the "Provost" at Excelsior College (oh yeah, her hubby just happens to lead the Presidents' Forum of Exlax [sic] College [again, just how many ways can you spell NEPOTISM?]). Dana recently had the results of some “research” she completed while still at Capella published. What? An Offerman can conduct "research?" Tell us it’s not true!

Dana's "research" has appeared in an overpriced book entitled, "Online Assessment and Measurement: Case Studies from Higher Education, K-12, and Corporate." Gosh, Michael Oaf Offerman can't even do that – after all, he's the one who lies about other bogus "research" his school conducts. For example, his outlandish claim that "WebCT was UNIVERSALLY praised for being exceptionally user-friendly and intuitive, and providing new and useful online tools." So, Mikey, where are the results of THAT study? Heck, the book just mentioned opens with "research" about WebCT – just think, your bogus study could have brought in more bucks had you published it. Why are you so AFRAID to publish your "study”" Of course, Oaf Offerman can't publish anything because Capella University NEVER determined that WebCT was "UNIVERSALLY praised for being exceptionally user-friendly and intuitive." In fact, we've never seen ANYONE make such an outrageous claim about WebCT although it's not difficult to find a LOT of complaints about it.

Getting back to Dana’s exciting research on "Assessing the Relationship between LEARNER satisfaction and Faculty Participation in Online Course Discussions" (BTW, "LEARNER" is Capella-speak for the term "student" – a rather asinine and demeaning moniker, to say the least) uncovered a couple of things which must have slipped through Capella's Advertising Department. Of course, these "revelations" don't surprise us in the least. So, as good 'ole Mikey Oaf Offerman is such an unprofessional coward and refuses to release other "research" his "school" conducts, we thought we would let the world know what Dana "discovered." BTW, we suggest that readers go to their public library and obtain (through interlibrary loan, if need be) a copy of "Online Assessment and Measurement: Case Studies from Higher Education, K-12, and Corporate" (ISBN - 1591407214) in order to verify the following findings (no need to spend big bucks [a whopping $85!] on "research" that appears designed to sell Capella University's programs). Here are a couple of our favorite "findings" from Dana's "research":

Page 35 – "a lack of instructor feedback emerged as a theme across all sections and all schools."

Really, it can't be true?! Capella's LEARNERS, from all sections and schools were upset about the lack of instructor feedback?! Heck, and all this time we thought the problem was only with charlatans like Diane Stottlemyer (the Capella "instructor" who literally bought and used entirely FAKE degrees from a diploma mill). Gosh Dana, why don't you look into the fact that your hubby engages in the unethical practice of hiring and retaining such frauds?

Page 37 – "Learners generally believed that instructors provided insufficient feedback to assignments and discussions and generally provided too little interaction and responses in the courseroom [sic]."

Oh no, please don't let it be true! LEARNERS feel ripped off because they spend approximately $2,000 per class, lead by charlatans (again, like Diane Stottlemyer) and yet have the audacity to whine about absent instructors who are too busy collecting paychecks instead of worrying about their students (oops, make that LEARNERS)? Fact Fifty-four (October 11, 2007) – Capella University: An Honest Review of Michael Offerman’s Hypocrisy

Some things are so funny that they can't be ignored. For example, Capella's Feeble President, Michael Oaf Offerman – the one who lies about bogus studies (i.e., Capella's WebCT study that he stated was "UNIVERSALLY praised for being exceptionally user-friendly and intuitive, and providing new and useful online tools," was "recently featured" in an article on "College Accountability" that appears on "Inside Higher Education." We've got to admit, using Offerman's name in the same sentence as the word "accountability" is almost obscene! It didn't take much effort; however, to reveal just how absurd the Inside Higher Education article really is – it almost reads like an advertisement for Capella University!

Let's take a look at some of the FACTS pertaining to Oaf Offerman’s role as the lead of the "panel of the Presidents' Forum of Excelsior College that crafted the accountability proposal." First of all, guess who serves as the provost at Excelsior College? Dana Offerman! What, another Offerman? Why of course – good 'ole Dana used to be the "vice provost" at Capella University who served under provost Karen Viechnicki – the very same one who lied to a law enforcement agency of the United States Department of Education. It gets even better though! Dana Offerman also happens to be Michael Oaf Offerman's wife! So, how many ways can we spell "nepotism?" Rather disgusting, to say the least. We'll soon be reporting on good 'ole Dana Offerman and a hilarious piece of "research" she did involving her hubby's school, Capella University.

According to information gleaned on the 'net, Excelsior College has proudly proclaimed that they are "a private, not-for-profit college [whose] business practices are in many instances aligned with those of for-profit institutions." Gosh, isn't that impressive? Certainly not something we would brag about. Currently, Exlax [sic!] College is the proud home of the Presidents' Forum (led by Michael Oaf Offerman) which has just recently released their "Principals of Good Practice" which claims

". . . were developed to ensure that higher education courses and programs for adults learning at a distance are of high quality and readily accessible" and that these "principles facilitate the continuous improvement of adult higher education programs delivered at a distance by establishing benchmarks of quality."

Oh, puulllleeeeeeeaze! Pardon us while we vomit! It doesn't take much effort to reveal just what a pile of hypocritical excrement in print these so-called "principles" really are. Let's examine some of the most hilarious ones:

"Principle 2.

"Accountability to Stakeholders The institution demonstrates its accountability to stakeholders by openly sharing aggregate learning assessment results, quality indicators, and academic program reviews of its distance education courses and programs."

FACT: Michael Oaf Offerman stated that Capella University's study of WebCT was "UNIVERSALLY praised for being exceptionally user-friendly and intuitive, and providing new and useful online tools" and yet both he and Capella University have REFUSED to publish these. In fact, Offerman's lies about this so-called study are so egregious that Capella’s own shysters from the "law firm" of Drinker Biddle & Reath, Sir Chrisy the Sissy L'Orange the Liar and Horse's Ass Capella Stella Fey Epling had to ask for a "protective order" from a Federal Court in order to prevent this non-existent study from being made available to the public. Of course, even L'Orange's and Epling’s "protective order" can't hide that fact that Capella NEVER studied the FACT that WebCT is not accessible to those with disabilities, along with the FACT the Capella NEVER conducted any studies which determined that WebCT was, as Oaf Offerman stated was "UNIVERSALLY praised for being exceptionally user-friendly and intuitive!"

"Principle 5. Curriculum Delivery

"The institution ensures that the content and quality of its courses and programs are comparable regardless of delivery method. The distance delivery model(s), course materials, and technology are appropriate to the content and needs of the student, and do not create barriers to learning."

FACT: If Michael Oaf Offerman really believes this then he most certainly must be delusional! Capella University doesn't give a damn about the fact that their own actions created "barriers to learning." Not only has Offerman's refusal to publish his bogus study of WebCT but both he and Capella University intentionally REFUSED to listen to all of the students who were complaining about the huge barriers to learning that his "school" created. All one needs to do is look at some of the actual complaints made by an extremely large number of students in order to reveal what a hypocritical liar Oaf Offerman really is. "Principle 7. Faculty Qualifications and Training

"The institution ensures that all faculty members engaged in distance delivery to adults meet the academic qualifications and standards required by the institution’s accrediting and oversight bodies."

FACT: Capella University hires and retains REAL charlatans, such as Diane Stottlemyer who have literally bought and used entirely bogus degrees from diploma mills. There is absolutely no way that Stottlemyer’s "degrees" from Lacrosse "University" would EVER "meet the academic qualifications and standards required by the institution’s accrediting and oversight bodies" Earth to Oaf Offerman, Earth to Oaf Offerman? Are you there?

"Principle 12. Disclosure

"The institution discloses throughout its marketing and communications, accurate, truthful information about its mission, accreditation, courses and programs, services, policies, transfer credit policy, tuition and fees, use of recruitment incentives, its recruitment processes, and other factors important to prospective and current students and other stakeholders."

FACT: Michael Oaf Offerman and Capella University not only REFUSE to "disclose" information about Capella’s unethical marketing practices but actually engages in hiding that information from the public. For example, the Chronicle of Higher Education just reported ("University of California Campus Collects a Bounty for Sending Students to a For-Profit College") on the FACT that Offerman was PERSONALLY INVOLVED in a kickback scam with his buddy from the University of California, Irvine, Gary Matkin, Dean of Continuing Education (and Kickback Affairs) whereby Capella pays $500 per student who transfers into Capella’s programs. As the Chronicle noted,

"In addition to accepting the money from Capella, the University of California at Irvine appears, according to e-mail messages and a student who uncovered them, to have tried to hide the payments.

While setting up the relationship, Gary W. Matkin, dean of continuing education at Irvine, wrote in a September 2002 e-mail message to Capella's president, Michael J. Offerman, to tell him that Capella's "lawyers still have problems with our marketing arrangement, even though we have been careful not to talk about per-student arrangements."

That's not all though! The Chronicle also noted Capella's and UCI's REFUSAL to provide additional information about this unfolding scam. Specifically,

"Like Ms. Lawhon, of Irvine, a spokesman for Capella, Michael Walsh, initially declined to comment, then issued a written statement. In the statement, he said 36 students had 'taken advantage of the articulation agreement over the past five years'. . .Both Ms. Lawhon and Mr. Walsh declined to say whether their universities were involved in similar practices with other institutions."

Why not, Michael Walsh? As one of Capella's spokesholes, why is Capella's lying president and Oaf, Michael Offerman feigning concern for "accountability" when, in FACT, he is involved in trying to COVERUP his personal involvement in this kickback scam? Just how many schools does Capella pay kickbacks to? Does his wife’s latest “school”, Excelsior College, also receive KICKBACKS from Capella?

Gosh, we almost forgot, Michael Oaf Offerman claims to be concerned about "accountability" (which, as far as we're concerned, is nothing more than another one of Capella’s publicity stunts). If Offerman was REALLY concerned with honesty and integrity, he would have made his bogus WebCT study public YEARS ago (that's what all REAL research institutions would do) as well as instantly disclose ALL of the schools that Capella pays kickbacks too. Then there's the little matter of the FACT that Offerman was also personally involved in the matter where Capella University was just found in violation, on TEN COUNTS, of intentionally violating Federal Law – the Family Educational Rights and Privacy Act (which, contrary to what Capella's shyster and "ever the legal scholar" Sir Chrisy the Sissy would have the world believe) is lovingly referred to as FERPA by those with a at least a few active neural firings. Of course, we already knew that Offerman was a liar – guess he's not too concerned about his hypocrisy and dishonesty as long as he keeps on getting even richer by cashing in on his insider options with Capella’s stock.

So much has happened during that past week that we're having a difficult time just trying to keep up with all of the scandal's Capella University is involved in! Highlights include:

* Capella University has been found in violation, on multiple counts, of the Family Educational Rights and Privacy Act (FERPA) and their chief shyster, Greg Thom was, not surprisingly mentioned numerous times for his role in Capella's intentional violation of Federal law!

* The kickback scandal involving Capella and the University of California, Irvine (UCI) is now blowing wide open thanks to an article that appeared in last week's addition of the Chronicle of Higher Education. That article noted that Capella has been paying UCI $500 per student that transfers into Capella - of course, Capella also pay UCI big bucks for other things too - such as $40,000 to "develop" just six courses!

* This will be that last week that Capella will be accepting "LEARNERS" (Capella-speak for "student") into their now almost defunct Psy.D. program (after trying for YEARS to obtain accreditation unsuccessful from the American Psychological Association they have probably finally given up trying - thank God for that)!

* It appears as if high ranking officials from Capella, including the President, Michael Oaf Offerman (who is also deeply involved in the Capella University - UCI kickback scam, are continuing to exercise their insider options (and making MILLIONS while they're at it) by cashing in on their soaring stock (which exceeded $60 per share over the past few days - more than TRIPLE the amount of their initial offering less than a year ago). Frankly, both Capella's and their shyster's continual claims that our sites have "damaged" their business is simply absurd!

Oh, there's just so much more. So, in honor of all of the scandals Capella is currently involved in, we thought we would mention the names of the Capella University and University of California officials who have been involved in the kickback scam. Not surprisingly, most of these not-so-wonderful "officials" have been involved in other scandals - including some in the very recent past!

So, just who are these clowns? Pictured from left to right are:

* UCI's Chancellor, Michael Drake (we'll be posting many of the scandals he's been involved in soon).

* UC President, Robert Dynes - Taxpayers and politicians alike have been demanding Dynes' resignation ever since his exorbitant lifestyle (paid for by taxpayers) was exposed by the media last year.

* UCI's Dean of Continuing Education - Gary Matkin. Besides the fact that he's personally involved in the kickback scam with his "buddy" Oaf Offerman, this clown would rather defend Capella than protect the students that his school uses to generate kickbacks.

* Last but not least, Michael J. Oaf Offerman, Capella's dishonest lying president who is making a killing by exercising his stock options as a Capella INSIDER! What's wrong Mikey? Why hasn't Capella University coughed up the "study" of WebCT that you claimed was "universally praised?" Oh yeah, that's right - Michael J. Oaf Offerman is a LIAR.

Capella University has intentionally violated Federal Law as determined by a law enforcement agency - the United States Department of Education (USDE), Family Policy Compliance Office (FPCO). In fact, it has determined that Capella has been found in violation on TEN COUNTS for their intentional refusal to comply with the Family Educational Rights and Privacy Act (FERPA) for their intentional failure to turn over education records. While FERPA requires all educational institutions to provide access to such records within forty-five days of the initial request, MORE THAN THREE YEARS have transpired and yet Capella has still not provided those records. Capella's illegal actions; however, are not surprising, especially since their chief shyster, Greg Thom, has not only been at the center of the ongoing investigation by the FPCO but has also actively engaged in LYING to them. As a result, we'd like to take a look at some of the people cited in the FPCO's determination that Capella University violated FERPA with a special focus on some of shyster Greg Thom's lies (there are so many that we’ll have to pick and choose just a few for now).

In his letter of finding to Capella's lying president, Michael J. Oaf Offerman, Mr. LeRoy S. Rooker, Director of the USDE, FPCO, states that:

"With regard to the online classroom 'communications,' Mr. [Greg] Thom explained in his March 7, 2005, response to this Office that "[C]ourse communications are dialogue strings between faculty and students, and between various students. In the online format, students enter a courseroom [sic] in which they engage in electronic discussions with their professor and with their fellow students. We do not retain all of these dialogues as part of a student's record."

FACT: Shyster Greg Thom intentionally lied to the FPCO, a Federal law enforcement agency. While shyster Thom told the FPCO, on March 7, 2005), that Capella, does "not retain all of [their course room] dialogues as part of a student's record," the hard facts demonstrate otherwise! For example, Capella University recently provided highly edited and CENSORED copies of some (but certainly not all) of the student's "online classroom communications” as part of the discovery process regarding that same student's lawsuit against Capella in a Federal Court and yet neither Greg Thom nor anyone else from Capella has EVER provided any of those documents to the student under his FERPA request. This fact, alone, PROVES that Greg Thom is a flagrant LIAR.

It gets even better – to date, more than THREE YEARS after the student's initial demand for his education records under FERPA, neither Capella University nor shyster Greg Thom have ever provided the student with access to the all education records that were created and maintained as part of the "online classroom communication" from the following instructors:

* Nancy Bois
* Jill Krout
* Nancy Johnson
* Kris Luopa
* Amar Almasude
* Diane Stottlemyer (Capella’s Charlatan who literally bought and used bogus “degrees” she acquired from the diploma mill, Lacrosse "University")

Of course, shyster Greg Thom’s ongoing refusal to turn over the above (and other) education records is just further proof that Capella University is in violation of Federal Law.

Then, in regard to another set of records created by one of Capella’s unethical buffoons and liars, Tamara Kuchar, who told the USDE, Office for Civil Rights (OCR) in a related complaint that "she provided copies of her notes [pertaining to the student] to the ASC [Capella University’s Kangaroo Court]. . ." Of course, the fact that Greg Thom and Capella University have NEVER produced these (and other) records to OCR, the student, or for that matter, any one else, there can be no question as to the FACT that the morons from OCR failed to investigate related complaints against Capella University with any semblance of competency. In fact, the dolts from OCR were so incompetent in their "investigation" by their failure to obtain many of the most damning documents created by Capella, merely highlights OCR's incompetence. Now that the USDE, FPCO has found TEN violations of FERPA, we want to mention the names of the incompetent morons from OCR who failed to do their jobs – these dolts include OCR's"

* Mark A. Farr: Mark.Farr@ed.gov – This oaf not only failed to obtain all of the documentation pertaining to the case but also intentionally failed to investigate all of the facts pertaining to Capella’s bigotry and discrimination against students with disabilities. In fact, this jerk is so incompetent, that he couldn’t even create an accurate timeline of the events in which Capella Retaliated against a student.

* Linda A. McGovern - Linda.McGovern@ed.gov – McGovern is the perfect example of the Peter Principal at work. Pathetically, McGovern serves as the "director" of OCR’s Chicago Office (which, in the past, has had far more appeals filed against them than any other OCR Office), merely rubber-stamped Mark Farr’s incompetent "investigation."

While we don't want to go into OCR’s incompetence at this time (we promise it will be discussed again in the future), we would like to continue with shyster Greg Thom’s intentional failure to abide by the law (FERPA). For example, in the FPCO’s recent findings letter, they stated that,

"According to Mr. Thom, these records were not provided to the Student because they were personal notes and never included as part of the Student's academic record. . . Once the contents or information recorded in sole possession records is disclosed to any party other than a temporary substitute for the maker of the records, those records become education records subject to FERPA. Because Ms. Kuchar's personal notes were shared with OCR, they can no longer be exempted from the definition of an education record under FERPA. Therefore, we ask the University to provide the Student the opportunity to inspect and review these notes."

So then, why did shyster Greg Thom and Capella refuse to turn these records over? The answer is simple, of course! Shyster Thom and Capella are intent of violating the law!

Perhaps even more revealing was the FPCO's reference that,

". . . by letter dated March 7,2005, Mr. Gregory Thom, Vice President, General Counsel, and Secretary, explained that the University complied with a portion of the Student's July 10 request, but did not provide the Student access to 'course communications,' asserting that such communications are not education records under FERPA because they are not maintained "as part of a student's record."

Of course, like Capella's shysters from the "law firm" of Drinker Biddle and Reath, Sir Chrisy the Sissy Hank Christian L'Orange the Liar and Horse's Ass Capella Stella Fey Epling, Greg Thom is also not the "legal scholar" he and his sleazy buddies claim to be. In fact, Greg Thom and Sir Chrisy the Sissy L'Orange appear to be just the opposite - mental misfits when it comes to understanding SIMPLE laws such as FERPA. Heck, L'Orange can't even pronounce the acronym (He refers to it as F-E-R-P-R-A)! Of course, Capella's other shysters, Capella Stella Fey Epling and Ms. Gurning Champion, Priscilla McNulty (the one who literally makes faces at people during depositions) aren't guiltless either. In fact, shyster McNulty had a veritable temper tantrum, after her recent participation in one of Capella's abusive depositions in which she came unglued by crying that Capella had NOT violated FERPA. Obviously, the reality is that Capella has now been found to have violated FERPA law ten times - which only goes to demonstrate, once again, that McNulty is also not a "legal scholar." Frankly, we're "getting sick and tired" of abusive outbursts from shysters like McNulty who are participants in Capella's illegal actions.

The FPCO findings letter then provided Capella's unethical lying president, Michael J. Oaf Offerman and shyster Greg Thom and Capella with the legal definition for "education records" (as neither he nor ever-the-legal-scholar shyster Hypocrite Hank Christian L'Orange are capable of reading); specifically that letter noted:

"34 CFR 8 99.3 'Education records.' The term 'Record' under FERPA means any information recorded in any way, including, but not limited to, handwriting, print, computer media, video or audio tape, film, microfilm, and microfiche. 34 CFR 6 99.3 'Record.' Therefore, any course communication that directly relates to the Student and that the University continues to maintain meets the definition of an education record under FERPA."

The FPCO letter goes on to make one of the most revealing statements about Capella's and Greg Thom's intentional and willful failure to abide by the law with the following statement:

"There is no explanation as to why such records were denied the Student by the University or a reason under FERPA that supports such denial. We find, therefore, that the University violated FERPA when it did not provide the records . . ."

Before we close this "FACT of the Day" we also want to make sure that we provide our readers with a list of all members of Capella University’s goon squad that was mentioned in the FPCO's letter of finding regarding the school's multiple FERPA violations; these thugs include:

Based upon the fact that it's already been more than THREE YEARS since the initial FERPA request was made, we're not going to hold our breath!
