Executive Risk Specialty Insurance Company Won't Pay for Capella's Lawsuit!

We salute Executive Risk Specialty Insurance Company for standing up to the abusive practices at Capella University. While details about Capella's latest frivolous lawsuit against those who refuse to support their abusive practices, an examination of the court records is very revealing! (We intend to publish the complete records submitted to the court - after all, the entertainment value, alone, should be quite high!

Update! Executive Risk Files Their Response to Capella University!

Based upon actual court documents just submitted by Executive Risk Special Insurance Company (ERSIC) to the United States District Court for the District of Minnesota, Capella University has apparently lied once again! Gosh, what a surprise! Highlights include:

"ERSIC affirmatively alleges that on or about June 15, 2005, Plaintiff submitted an application for insurance. ERSIC relied on the representations in that application when they agreed to bind coverage for Plaintiff. ERSIC further affirmatively alleges that Plaintiff [Capella University] made misrepresentations of material fact in its application for coverage and that these misrepresentations void coverage for La Marca’s claims against Plaintiff under the Policy."

Our Analysis of Capella's Frivolous Lawsuit Against Executive Risk

Once again, the thugs at Capella University are showing what morons they are - this time, they're suing their insurance company because Executive Risk is refusing to pay for Capella's vicious and frivolous attack on a student. In their complaint filed with the court, Capella whines that Executive Risk has breached its duty to defend. Specifically, Capella University has been throwing huge amounts of money at attacking a student - so far, they could have not spent a significant amount DEFENDING themselves because the La Marca v. Capella University case is still in its initial stages! That's right, Capella University hasn't had to pay for much in their DEFENSE because they've are spending a huge amount in their attack against the student! We don't blame Executive Risk for refusing to pay for Capella's pernicious and merit less counter suit AGAINST a student - even a single reading of Capella's complaint reveals that their insurance company may NOT be obligated to pay for Capella's attacks on others. No where in Capella's complaint does it state that Executive Risk is obligated to pay for Capella to sue others!

As noted above, the La Marca v. Capella University case is still in its infancy, to date:

1. The case has been stalled due to Capella's frivolous counter suit.
2. Capella is responsible for these delays as a direct result of their ongoing smear campaign, being conducted by another one of their law firms, Drinker Biddle.
3. The actions and behavior of Capella University and their Drinker Biddle attorneys, H. Christian L'Orange (Sir Chrisy the Sissy), and Capella Stella Fey Epling has been reprehensible - we'll soon be adding an entirely new section on this site to document the sleazy tactics being used by Sir Chrisy the Sissy and Capella Stella to attack the student! (Until then, be sure to visit the page that shows that Capella Stella has lied to the court!)
4. No depositions have yet been taken of any of the liars, goons, thugs, and other sleaze balls from Capella - not a single one. So far, Capella University hasn't had to defend anyone! To date, only Capella has been given any opportunity to do conduct a deposition as part of their sleazy counter suit AGAINST a student. Furthermore, no depositions of any Capella thugs have yet been scheduled.
5. No discovery has occurred (in other words, Capella has not yet been required, under court order, to submit a single document or other materials, as part of the discovery process in their defense). In fact, as of this date (February 23, 2006), neither the court nor Capella has yet been provided with such a list.

Apparently, the jerks and liars at Capella University think they can bilk their insurance company, Executive Risk, for money that they are not using in their defense but to attack others! More information will be posted on this site as it is available.
